2. ACCEPTANCE OF THE TERMS
By accessing our website (www.harocho.com), placing an order through our online ordering system provided by GloriaFood (FoodBoss), or dining at our premises, you ("the Customer") agree to be bound by these Terms and Conditions, our Privacy Policy, and the GloriaFood Terms of Service, available at https://harocho.com/en/terms-and-conditions and https://www.oracle.com/legal/terms.
If you do not agree with any of these terms, please do not use our services.

3. SERVICES OFFERED
Harocho is a restaurant specializing in Mexican cuisine and seafood. We offer the following services:
• Dine-In Service: We have a limited number of tables for on-site consumption. Seating is managed on a first-come, first-served basis (we do not accept reservations).
• Takeaway: You can pick up your order at our location.
• Home Delivery: We offer home delivery managed through our online platform and third-party services.
We use the GloriaFood (FoodBoss) platform to manage our digital menu and process online orders for pickup and delivery.

4. ORDER AND PAYMENT PROCESS
• Online Orders: Orders placed through our website are processed by the third-party service platform GloriaFood (FoodBoss), which acts as our agent for the management and confirmation of your pickup or delivery order.
• Dine-In Orders: Payment for consumption on the premises will be made at the end of the meal.
• Accuracy of Information (For Delivery): The Customer is responsible for providing a complete and correct delivery address, as well as a valid contact number. Any error in this information resulting in a failed or delayed delivery will not be the responsibility of Harocho LLC.
• Online Order Confirmation: The automatic order confirmation generated by the GloriaFood system indicates that we have received your request, but does not constitute acceptance of it. Acceptance of the order occurs when we send you a notification that your order has been shipped or is ready for pickup.
• Prices and Taxes: All prices are shown in US dollars (USD) and do not include applicable taxes, GloriaFood service fees (for online orders), delivery fees, or tips, unless otherwise indicated. The final price will be calculated at the time of payment.
• Payment: Payment for online orders is processed securely through the payment gateway integrated into the GloriaFood platform. You agree to pay the total price of the order, including all applicable fees.

5. SERVICE POLICY (DINE-IN, PICKUP, AND DELIVERY)
• Dine-In Service: Tables are assigned on a first-come, first-served basis. We strive to provide efficient service; however, during peak hours, waiting time for a table or for food may be affected.
• Delivery Management: Home deliveries are managed and coordinated through the GloriaFood platform and/or third-party services.
• Delivery Area: Our delivery service is limited to specific areas. We reserve the right to modify these zones.
• Estimated Times (Delivery): Provided delivery times are approximate and not guaranteed. Factors such as weather, traffic, and order volume can affect them.
• Customer Not Found (Delivery): If the driver cannot locate you at the provided address after a reasonable time, we reserve the right to cancel the order. No refunds will be issued if the address or contact information was incorrect.
• In-Store Pickup: For orders picked up at our location (16326 Renton Issaquah Rd SE, Renton, WA 98059), the customer is responsible for picking up their order within the provided estimated time.

6. RETURN AND REFUND POLICY
Given the nature of our products (perishable food prepared to order), we do not accept returns of food.
• Problems with the Order (Delivery/Takeaway): If there is a problem with your delivery or pickup order (e.g., missing item, preparation error), you must notify us within 30 minutes of receiving the order by sending an email to info@harocho.com with your order number, a description of the problem, and clear photos. We will evaluate each case individually and, at our discretion, may offer a credit for a future order or a partial/full refund.
• Problems During Dine-In Consumption: Any issue with your food must be reported immediately to our staff on the premises so we can seek a solution at the moment.
• Cancellations: Online orders may be cancelled free of charge only if requested through the platform or by phone before preparation has begun. Once preparation has started, cancellations will not be accepted.

7. ALLERGENS AND DIETARY INFORMATION
• General Warning: Our kitchen uses a variety of ingredients, including but not limited to: shellfish, gluten (wheat), dairy, eggs, soy, nuts, and sulfites.
• Cross-Contamination: Although we can accommodate specific requests, we do NOT guarantee an allergen-free environment. Our kitchen is a space where all these ingredients are handled, and there is an inherent risk of cross-contamination. THE CUSTOMER ASSUMES ALL RESPONSIBILITY for inquiring about ingredients and for communicating any serious allergies or dietary restrictions to the staff or when placing the order. The consumption of raw or undercooked shellfish and products carries an additional risk of foodborne illness.

8. INTELLECTUAL PROPERTY
All content related to Harocho, including logos, names, food images, designs, and texts, is the property of Harocho LLC and is protected by the intellectual property laws of the United States. The online ordering platform is the property of GloriaFood. Unauthorized use of any element is prohibited.

9. LIMITATION OF LIABILITY
To the maximum extent permitted by the applicable law of the State of Washington, Harocho LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, including, but not limited to, damages for improperly prepared food, foodborne illnesses, delivery delays, order errors, or loss or damage of personal belongings on the premises, even if we have been advised of the possibility of such damages. This limitation of liability applies equally to any failure or error in the service provided by the GloriaFood platform.

10. GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, United States. Any dispute arising out of or relating to these terms shall be submitted to the exclusive jurisdiction of the courts located in King County, Washington.

11. CHANGES TO THE TERMS
We reserve the right to modify these Terms and Conditions at any time. Changes will take effect immediately after being posted on our website. Continued use of our services after such changes constitutes your acceptance of the new terms.
